Decision No 45 of Moldova's National Extraordinary Public Health Commission from 15 February 2021

Chisinau, 15 February /MOLDPRES/ -Under the Article 58 from the Law No 10/2009 on the state supervision of the public health sector (Official Journal, 2009, No 67, Article 183), with the subsequent amendments, as a result of the analysis of the evolution of the epidemiological situation nationally and internationally, the National Extraordinary Public Health Commission (CNESP) finds out that the epidemiological situation remains unfriendly.

As many as 170,186 cases of COVID-19 infections have been recorded in Moldova till 14 February 2021, of which 3,651 deaths and 157, 427 treatment cases and 9,108 remain active cases, 4,779 people persons have easy forms of the disease and are treated at home; 3,146 are hospitalized, of whom 282 people are in extremely serious condition, 1,110 are in serious condition and 1,594 are in medium seriousness condition.  

Proceeding from the aforementioned facts, CNESP  

DECIDES:

1. The emergency state in the public health sector, declared under the Decision No 35 from 27 November 2020 by the National Extraordinary Public Health Commission, is extended all over Moldova till 15 April 2021, with possibility to revise the concerned term, depending on the evolution of the epidemiological situation nationally.  

2. The measures of prevention and control of the COVID-19 infection, applicable nationally, provided for in the Annex to the Decision No 35 from 27 November 2020 by the National Extraordinary Public Health Commission are maintained, with the subsequent amendments.   

3. The measures of prevention and control of the COVID-19 infection are maintained at the crossing of the state border in the direction of entering Moldova, according to the Annex 1 of the Decision No 42 from 13 January 2021 by the National Extraordinary Public Health Commission.

4. The carrying out of activities of commercial/servicing units for the kinds of activities included in the code CAEM 56.30 and the code CAEM 93.29, no matter the name of the firm of the unit (for instance, disco-pub, night club, karaoke, discotheque, club, etc.), is banned.  

5. CNESP bans the carrying out of activities of servicing in public nourishment units (of the type of restaurants, pubs, canteens, coffee houses), as well as in the public nourishment units placed in the points of selling oil products, commercial centres, airports, international ports and in the international state border crossing points in the time interval 22:00-07:00, except for the commercialization of food products in packages, through public nourishment units of any type, with excluding the possibility of their consumption at the headquarters/on the territory of the unit.       

6. The point 10 of the Annex to the Decision No 35 of the National Extraordinary Public Health Commission from 27 November 2021 is set forth in the following version:

„10. The organization and carrying out of festive events in the public nourishment units is allowed with a smaller number than 20 guests, with the observance of the public health measures and of the Instruction on preventing the COVID-19 infection concerning the carrying out of festive events in the public nourishment units, according to the Annex No 1 of the Decision No 21 of National Extraordinary Public Health Commission from 24 July 2020, with the subsequent amendments.’’  

7. The point 4.4 of the Annex to the Decision No 35 of the National Extraordinary Public Health Commission from 27 November 2021is set forth in the following version:   

„4.4. limiting of the number of people in the district and inter-district railway and road transport to 50 per cent of the capacity and in the local and municipal road transport - within the limit of 50 per cent of the embarkation capacity.’’

8. The work of the commercial centres is ceased nationally on Saturdays and Sundays as of 17 February 2021, by ensuring the functioning as normal of the units for the sale of food products and pharmaceutical products, placed at their headquarters.    

9. The work of commercial markets is restricted for work only on Tuesdays, Thursdays and Saturdays on the period 17 February – 1 March 2021, excepting the agricultural markets.   

10. As for the economic agents carrying out activities of commerce/providing services in closed spaces, the Commission establishes the concomitant allowing to the commercial/servicing space of a limited number of clients, proceeding from the norm 1 visitor/four square metres of free commercial area (area without trade equipment).  

11. The carrying out of activities with the presence of audience is banned in movie theatres.

12. CNESP allows the carrying out of activities with the presence of audience at the theatre and concert institutions and community centres at the capacity of 50 per cent of the number of places, but no more than 250 spectators for the halls with a capacity larger than 500 places, with the observance of the instruction on the measures of prevention and control of the COVID-19, applied at the organization of cultural events/actions at the headquarters of theatre and concert institutions and community centres, approved through the Decision No 31 of the National Extraordinary Public Health from 24 September 2020.  

13. The leaders of the public and private institutions are instructed to establish a flexible or special working schedule, with the attraction to work of the strictly needed staff, to insure the functionality of the institution and of the personnel, the activity of which needed the compulsory presence at work. Distance work must be ensured for the staff the presence of which is not compulsory at work. On the period of carrying out the position duties at home, the employees fulfill their duties specific for the office they hold. The employer has right to verify the activity of the employees who work at home. The concrete way of exercising the control will be mutually agreed upon by electronic communication means.     

The ministries, State Chancellery, other central administrative authorities subordinated to the government and the organizational structures within their competence (subordinated administrative authorities, including the de-concerted public services and the subordinated ones, as well as the public institutions, state enterprises and commercial companies with full or majority public capital, in which the ministry, State Chancellery or other central administrative authority has capacity of founder) will organize the activity in the special working regime starting from 7:30 till 16:00 and dinner break as of 12:00 till 12:30, with subsequent revision, depending on the epidemiological situation.        

14. The public order sector authorities are asked to intensify the supervision of the observance by private people and legal entities of the measures of prevention and control of the COVID-19 infection.

15. The territorial extraordinary public health commissions will ensure the revision of all decisions/instructions approved, bringing them in line with the Decisions of the National Extraordinary Public Health Commission of Moldova.  

16. The restrictive measures will be revised, depending on the evolution and tendency of the epidemiological situation of the COVID-19 infection.

17. The decisions of the National Extraordinary Public Health Commission are executory for the central and local public administration authorities, for private people and legal entities, no matter the activity sector and the legal form of organization.  

18. CNESP recommends that media representatives inform the public about the need to strictly observe the measures of prevention and control of the COVID-19 infection.

19. The non-observance of the public health measures, set forth in the present Decision, represents danger for the public health and will serve as reason for calling the guilty people to contravention/criminal account. 

20. The present decision enters into force starting the moment of its issuance and is published on the Government’s official webpage.
