New requirements for contracts to supply digital content, services

Chisinau, Nov 26 /MOLDPRES/- The rights of consumers of digital content or services will be better protected. Provisions to this effect have been included in the law on contracts for the supply of digital content and services, which was published in the Official Journal today.
The draft transposes into national law a directive of the European Parliament and of the European Council on certain aspects of contracts for the supply of digital content and services. Thus, the document provides for the establishment of a clear set of rules for the sale and consumption of digital content, such as computer programs, software, games, digital books or DVDs, CDs or sticks, if they are carriers of digital content or services.
It also contains provisions aimed at protecting consumer rights. Consumers will have at least two years to request a remedy if they find defects in digital content. If the defects are repetitive or serious, consumers will be able to return the product, keep the product and receive part of the price paid, or return the product and get their money back.
The authority responsible for exercising control over compliance with the provisions on the provision of digital content or service is the State Inspectorate for Supervision of Non-Food Products and Consumer Protection of the Ministry of Economic Development and Digitalization.
The Law shall enter into force upon expiration of 12 months from the date of its publication in the Official Journal of the Republic of Moldova. Government within six months from the date of its entry into force shall bring its normative acts in line with it.
